The November 3, 2026 Election
The Election Commission administers the incorporation and charter commission election for the proposed Municipality of Niwot. Six Niwot residents were appointed to the Commission by order of the Boulder County District Court on May 21, 2026. Our role is procedural: to see that this election is conducted lawfully, fairly, and on schedule. We take no position on whether Niwot should incorporate.
Written comments for and against the five fiscal ballot questions are due. Every registered elector receives a mailed notice before the election summarizing the comments filed for and against each question, and the Commission compiles those summaries from what residents file. A comment must state the voter registration address of the person submitting it.

What Is on the Ballot
Registered electors residing within the proposed boundary will vote on three things in the November 3 coordinated election:
- Incorporation — whether to organize the territory described in the petition into a municipality under Colorado law.
- Charter commission — whether to form a nine-member home rule charter commission, and which nine candidates to elect to it. If incorporation passes, those commissioners draft the charter that would then go back to voters.
- Fiscal questions — the measures required under Article X, Section 20 of the Colorado Constitution (TABOR) authorizing the new municipality to levy taxes, issue debt, and retain revenue.
The election is conducted by the Boulder County Clerk and Recorder as part of the November coordinated election. Voter registration, ballot delivery, and drop-box locations are handled by the County Clerk, not by this Commission.
