The November 3, 2026 Election
The Election Commission administers the incorporation and charter commission election for the proposed Municipality of Niwot. Six Niwot residents were appointed to the Commission by order of the Boulder County District Court on May 21, 2026. Our role is procedural: to see that this election is conducted lawfully, fairly, and on schedule. We take no position on whether Niwot should incorporate.
Written comments for and against the five fiscal ballot issues are due. Every registered elector receives a mailed notice before the election carrying a summary of the comments for and a summary of the comments against each issue. The Commission compiles the summaries against; under TABOR the summaries in favor are written by the representatives of the incorporation petition, not by the Commission. A comment must state the voter registration address of the person submitting it.

Review and approve revisions to the summaries of written comments against the five fiscal ballot issues, incorporating further comments filed with the Commission. The finished notice for each issue goes to the Boulder County Clerk and Recorder by 4:00 p.m. the same day.

What Is on the Ballot
Registered electors residing within the proposed boundary will vote on three questions and five fiscal issues in the November 3 coordinated election. The two series are numbered separately, so a measure is named by its series as well as its number.
- Question 1, Incorporation — whether to organize the territory described in the petition into a municipality under Colorado law.
- Question 2, Charter commission — whether to form a nine-member home rule charter commission. If incorporation passes, those commissioners draft the charter that would then go back to voters.
- Question 3, Charter commission members — which nine of the 28 candidates to elect to that commission.
Issues 1 to 5 are the fiscal measures required under Article X, Section 20 of the Colorado Constitution (TABOR): a sales and use tax, a property tax, a marijuana special sales tax, authorization to retain and spend all revenues, and authorization to increase debt. See the full ballot content →
The election is conducted by the Boulder County Clerk and Recorder as part of the November coordinated election. Voter registration, ballot delivery, and drop-box locations are handled by the County Clerk, not by this Commission.
